LLC name availability in Montana

Montana's official business search at biz.sosmt.gov checks one thing: whether your proposed name conflicts with entities already registered in the state database. That is a necessary first step. It is not a complete one.

Here is what the SOS portal does not reveal:

Whether the .com domain is available or held by a squatter

Whether a federal trademark already covers your name or something confusingly similar

Whether a competitor operates under that name through common-law use without state registration

Montana had more than 42,500 active LLCs as of recent SOS data. National business formation hit a record 5.5 million new applications in 2023, according to the U.S. Census Bureau Business Formation Statistics. Competition for clean, available names is intense. Running only the state search and calling it done wastes a $70 filing fee on a name you cannot actually build a brand around.

Before you search, understand what Montana will and will not accept. The governing statute is Montana Code Annotated § 35-8-104, which establishes all naming requirements for limited liability companies formed in the state.

Required designator. Every Montana LLC name must include one of these approved endings:

1. Navigate to biz.sosmt.gov

2. Select "Business Search"

3. Enter your proposed LLC name

4. Review results for both exact and similar matches

5. Separately visit GoDaddy or Namecheap to check domain availability
