These terms govern your use of BizNameChecker (biznamechecker.com), operated by One Six LLC, a United States company. By using the service you agree to these terms. If you do not agree, do not use the service. Questions go to [email protected], which is monitored.

What this service is

BizNameChecker is a free tool for checking whether a business name is available. You type a name and we check it against public records and registries, and we add further checks over time. There is no sign-up and nothing to pay. If you ask us to unlock more state checks after the free daily limit, you provide an email address and business name, which we handle as described in the privacy policy. We do not sell domains, we do not register domains, and we do not file LLC paperwork. Acting on a name, such as registering a domain or filing LLC paperwork, happens with independent third parties: domain registrars, state filing offices, and formation services.

Availability results carry no warranty

Every result the service shows is informational only. Results are compiled from third-party registries and public government records, and they can be stale, incomplete, or wrong. A result is not legal advice. A result that a name appears available is not a guarantee that the name is legally available for you to use, register, or trademark. Names can be subject to trademark rights, common-law rights, and state naming rules that no automated check reveals. We make no promise about the accuracy, completeness, or freshness of any result, and we make no promise that the service itself will be available or error-free.

Verify before you rely on anything

Before you spend money, file paperwork, or commit to a name, verify it yourself: confirm LLC availability with the state's filing office, confirm domain availability with a registrar, and consult an attorney for trademark and naming questions. Do not rely on this service as your only source.

Acceptable use

The service is for people checking names, at human speed. You may not scrape the service, query it in automated bulk, resell the data it returns, or do anything that disrupts it or circumvents its protections. Rate limits exist, and requests beyond them are refused. Use the service only for lawful purposes.

How we make money

The service is free to use. We earn money through affiliate referrals: some links on the service go to partners, such as business formation services and domain registrars. When you buy something through those links, the partner may pay us a commission. This costs you nothing extra, and it does not change the availability results we show you.

Third-party sites

The links we show lead to independent third parties. Anything you do on their sites, including registering a domain or forming a company, is governed by their terms and their policies, not ours. We are not a party to any transaction you make with them and are not responsible for their services, prices, or conduct.

Intellectual property

The BizNameChecker name, logo, site design, and original content belong to One Six LLC. The government records we display, such as state business registries and the federal trademark register, are public records; we claim no ownership over them.

No warranty and limited liability

The service is provided as is and as available, free of charge. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the same extent, One Six LLC is not liable for any indirect, incidental, special, or consequential damages, or for losses that come from relying on a result, and our total liability to you for all claims arising from the service is limited to one hundred United States dollars. Some jurisdictions do not allow certain warranty or liability limits; where that is the case, these limits apply to the fullest extent permitted.

Changes

If we change these terms, we post the updated version at this URL with a new effective date. Using the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and any dispute belongs in the state or federal courts located in Florida.
